Privacy Policy

1. Overview
This Privacy Policy explains how Kernova AI (“Kernova”, “we”, “us”) collects, uses, discloses, and protects personal data when you visit kernova.ai (the “Site”), request early access, or use the Kernova optimization platform (the “Service”).
Kernova AI is the data controller for personal data processed through the Site. When we process workload traces or telemetry on your behalf as part of the Service, you are the controller and Kernova acts as a processor under a separate Data Processing Agreement.
This document is a template prepared for the Kernova AI website launch. Before publishing, have it reviewed by qualified legal counsel and replace bracketed placeholders with your registered entity details.
2. Data we collect
Account and contact data: name, work email, company, role, and any message you send when requesting access or contacting support.
Usage data: pages visited, interactions, approximate location derived from IP address, device and browser type, and referring URLs, collected through privacy-respecting analytics.
Workload data (Service only): operator-level execution traces, kernel configurations, and performance measurements from workloads you choose to profile. This data may indirectly contain information about your models and infrastructure; it is processed solely to provide the optimization Service.
We do not intentionally collect special categories of personal data, and the Service is not directed at children under 16.
3. How we use data
To provide, operate, and improve the Service, including profiling, kernel generation, and validation reporting.
To respond to access requests, support inquiries, and to send product updates you have opted into.
To secure the Site and Service, prevent abuse, and comply with legal obligations.
We do not sell personal data, and we do not use your workload data to train models for other customers.
4. Legal bases (EEA/UK)
Contract: processing necessary to provide the Service you requested.
Legitimate interests: improving the Service, securing our systems, and communicating with business contacts, balanced against your rights.
Consent: optional marketing communications and non-essential cookies, which you can withdraw at any time.
Legal obligation: records we must keep under applicable law.
5. Sharing and processors
We share personal data with a limited set of subprocessors that help us operate: cloud hosting providers, email delivery services, and analytics providers. Each is bound by contractual data protection obligations.
We may disclose data where required by law, to protect rights and safety, or as part of a merger or acquisition, subject to this Policy.

6. International transfers
Where personal data is transferred outside the EEA/UK, we rely on adequacy decisions or Standard Contractual Clauses with supplementary measures as appropriate.
7. Retention
Contact and account data is kept for as long as your account is active and up to 24 months afterwards, unless a longer period is required by law.
Workload traces are retained for the duration of your project and deleted within 30 days of account closure, unless you request earlier deletion.
8. Your rights
You may request access, rectification, erasure, restriction, portability, or object to processing of your personal data. EEA/UK residents may also lodge a complaint with their supervisory authority.

9. Cookies
The Site uses strictly necessary cookies for security and session integrity. Analytics cookies are only set with your consent. You can change your choice at any time through your browser settings.
10. Security
We apply encryption in transit and at rest, least-privilege access controls, and audit logging. No method of transmission is 100% secure; if we become aware of a breach affecting your data, we will notify you and the relevant authority as required by law.
11. Changes to this policy
We may update this Policy from time to time. Material changes will be announced on the Site or by email at least 14 days before taking effect. The “last updated” date below shows the current version.
